Overtime

Overtime in West Virginia

The Fair Labor Standards Act (FLSA) was a comprehensive federal statute that guarantees a worker's right to be paid fairly, and regulates hours, wages, and working conditions of employees and also child labor. This federal scheme set out and provided the federal minimum wage (not West Virginia minimum wage), record keeping requirements, the states requirements for overtime (including West Virginia), i.e. the right to overtime pay, and child labor regulations. An exempt employee is a worker (in West Virginia or elsewhere in the United States) who is not entitled to extra pay for overtime hours worked under the Fair Labor Standards Act.
